Consultations on new regulations and codes of practice

As part of the implementation of the Social Services and Well-being (Wales) Act, Welsh Government are consulting on a number of new regulations and codes of practice.

The draft regulations and code of practice were developed through consultation with several stakeholder Technical Groups. 

The regulations will be made under the appropriate sections of the Act.  The codes of practice are issued under section 145.

This first batch of consultations relate to parts 2, 3, 4, 7 and 11 of the Act.

Part  2 (General Functions) of the Act contains a number of regulation-making powers relating to:

  • functions of a local authority
  • carers well-being
  • population assessments
  • preventative services
  • social enterprises
  • information, advice and assistance.

Part 3 covers assessing the needs of individuals.
Part 4 of the Act  covers:

  • how to decide whether people are eligible for care and support
  • direct payments
  • the planning of care and support.

Part 7 (Safeguarding) of the Act covers:

  • the strengthening of arrangements for children at risk
  • new legislation to protect adults at risk, including a duty to report and enquire
  • a new Adult Protection and Support Order
  • new Safeguarding Adults Boards
  • a National Independent Safeguarding Board.

  • prisoners and young people in youth detention
  • ordinary residence
  • disputes about ordinary residence.
